What is Considered Negligent Security?

Negligent security is a special type of premises liability claim that involves the acts of a third party on the premises of another person. In order to claim negligent security, the victim of a crime or attack must be able to show that the property owner’s lack of security created a hazardous condition which resulted in the victim’s injuries. There are many different examples of negligent security that allow an attacker to assault or harm unaware guests, including the following:

  • Lack of security guards
  • Lack of security cameras
  • Lack of proper lighting in buildings or in parking lots
  • Broken locks
  • Lack of fencing or holes in fencing
  • Overbooked accommodations, and more.

Injuries Caused by Negligent Security Incidents

The injuries caused by incidents involving negligent security are often more severe than other types of premises liability claims because of the violent nature of the attack. Negligent security incidents often result in devastating physical injuries and long-term psychological damage to victims, or worse. Some of the injuries reported in negligent security cases include:

  • Head trauma
  • Traumatic brain injury
  • Facial trauma
  • Broken bones
  • Gunshot wounds
  • Stabbing and other penetrating wounds
  • Internal organ damage
  • Internal bleeding
  • Sexual assault injuries, and
  • Death

Given the catastrophic nature of many of these injuries, it is critical that victims of negligent security incidents receive the full and fair compensation for their case.

Compensation for Negligent Security Injuries

Compensation for claims involving negligent security includes both economic and noneconomic damages caused by the incident. Economic damages include medical expenses, property loss, lost wages, and the loss of future income and benefits, along with any other out of pocket expenses. Noneconomic damages compensate a victim for their pain and suffering, emotional distress, disability, disfigurement, and loss of enjoyment of life. Given the substantial emotional and psychological damage caused by negligent security incidents, the noneconomic damages for a victim can be significant in this type of claim.

In the worst cases, when a victim dies from an attack caused by negligent security, the family of the victim may also seek compensation for wrongful death. This includes compensation for any final medical bills, funeral and burial costs, lost wages, and for the loss of the victim’s love, guidance, and support.
